Privacy Policy
Last updated October 20, 2026
This Privacy Policy explains how Elite 4 Battle Pass ("Elite 4 Battle Pass," "we," "us," or "our") collects, uses, shares, and protects personal information when you use elite4jello.com and related pages, emails, and features (together, the "Service"). The Service is a loyalty and points game for viewers and buyers of our live-stream Pokémon card shows on Whatnot and TikTok and for our Discord community. We are based in San Diego, California, USA.
- We collect your sign-in details (like your email or Google account basics), the usernames you link from Whatnot, TikTok, and Discord, and your points, purchases at our shows, rewards, and activity.
- We use this to run the game, keep a customer record for you, personalize the Service, analyze how it is used, and (unless you opt out) send you marketing emails.
- Your display name, points, rank, and avatar may appear on public leaderboards. You can ask us to hide your profile from public pages.
- We do not sell your personal information for money. We use, or plan to use, analytics and advertising cookies and pixels (for example from Meta, TikTok, and Google), which California law may treat as "selling" or "sharing" personal information. You can opt out at any time (see section 7).
- The Service is for people 13 and older. It is not directed to children under 13.
- You can contact us at battlepass@elite4jello.com to access, correct, or delete your information, or to unsubscribe.
1. Information we collect
Depending on how you use the Service, we may collect:
- Account and contact details: your email address, the display name you choose, and an internal account ID. If you sign in with Google, we receive your name, email address, profile picture, and Google account ID.
- Linked platform identities: usernames, handles, user IDs, and public profile details for accounts you tell us about or link, such as Whatnot, TikTok, and Discord.
- Purchase and loyalty history: records of what you bought or won at our shows (for example item, date, price or price range, and show), points earned and spent, season and lifetime totals, tiers and ranks, streaks, attendance, chases, pick tickets, rewards, and cosmetic items you own or equip. We do not collect or store your payment card details; payments happen on the platform where you buy.
- Fulfillment details: if you win or claim a physical reward that we ship to you, the name and shipping address needed to send it.
- Profile and preference choices: your avatar and cosmetic choices, wishlists, interests, and settings such as whether your profile is hidden from public pages.
- DEX collection tracker: if you use the DEX tab, which species you have ticked, any card numbers you add, and whether you chose to show your total. Your DEX is private: other people can see only your total (for example 212 / 1,025), and only if you switch that on. The shop owner can see DEX progress to help source cards for customers; otherwise it is not shared.
- Communications: messages you send us by email, Discord, or on-platform chat, and survey or feedback responses.
- Device and usage information: IP address, browser and device type, cookie and device identifiers, pages viewed, actions taken (such as signing up or claiming a reward), dates and times, referring pages and ad clicks, and error logs, collected automatically when you use the Service, including through cookies and pixels (see section 9).
- Email engagement: whether our emails were delivered, opened, or clicked, where our email provider supports it.
- Inferences: conclusions we draw from the above, such as your favorite sets or products, how engaged you are, and which customer group you fall into.
We do not ask for sensitive personal information such as Social Security numbers, government ID, precise geolocation, or health information, and we ask that you not send it to us. Because sign-in uses one-time email codes or Google, we do not store passwords for customer accounts.
2. Where the information comes from
- From you, when you sign up, link accounts, update your profile, claim rewards, or contact us.
- From Google, if you choose "Continue with Google" (see section 4).
- From Whatnot, TikTok, and Discord, including order and buyer information made available to us as a seller, public profile information, and activity during our streams and in our community, to the extent each platform's terms allow.
- Automatically, from your browser and device when you use the Service, including through cookies, pixels, and similar technologies.
- From advertising and analytics partners, such as information about how you interacted with our ads.
- From our service providers, such as delivery and engagement information from our email provider.
3. How we use information
We use personal information to:
- Create and secure your account, sign you in, and verify your identity.
- Link your account to your Whatnot, TikTok, and Discord identities so purchases and activity are credited to you.
- Run the game: track and award points, tiers, ranks, chases, rewards, and cosmetics, and fulfill rewards.
- Maintain a customer record (CRM) of your purchase, points, and engagement history so we can recognize returning customers and serve you better.
- Personalize the Service, our shows, and our offers, for example by showing items or rewards that match your interests.
- Analyze how the Service and our shows are used, measure what works, and improve them.
- Advertise our shows, drops, and the Battle Pass, including on other websites and apps (such as Meta, TikTok, and Google), build audiences of people likely to be interested, and measure how well our ads work.
- Send you service messages (like sign-in codes, account notices, and reward updates) and, unless you opt out, marketing emails about shows, drops, and promotions.
- Display public leaderboards, standings, and a Hall of Fame (see section 5).
- Prevent fraud, cheating, and abuse; enforce our Terms of Service; and protect our rights and the safety of our community.
- Comply with law, respond to lawful requests, and keep business records such as tax and accounting records.
- For any other purpose we describe when we collect the information, or with your consent.
We may also create de-identified or aggregated information (for example, "average points per show") that does not reasonably identify you, and use it for any lawful purpose. We will not try to re-identify it.
4. Google user data and Limited Use
If you choose to sign in with Google, we request only the basic scopes Google calls openid, email, and profile. From Google we receive your Google account ID, name, email address, and profile picture. We do not request access to your Gmail, contacts, Drive, calendar, or any other Google data.
We use Google user data only to create and sign you in to your account, show your name and picture in your account, keep your account linked to the same email you use with us, and communicate with you about your account. We do not use Google user data to serve or target ads, we do not sell it, we do not share it with advertising partners (including through pixels or by uploading customer lists), and we do not transfer it to others except to our service providers as needed to provide the Service (for example, our authentication and database provider), to comply with law, or as part of a merger or acquisition with notice to you. Humans on our team do not read Google user data except as needed for security, to comply with law, to investigate abuse, or with your permission.
Elite 4 Battle Pass's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
You can remove our access at any time from your Google Account's security settings ("Third-party apps & services"). Removing access does not delete your Battle Pass account; to delete it, contact us.
5. Public leaderboards and profiles
The game is social. Your display name, avatar and cosmetics, points, tier or rank, season standings, achievements, and Hall of Fame placements may be shown publicly on elite4jello.com, during our live streams and stream overlays, and in our Discord and social posts. Your trainer handle (the Whatnot or TikTok username we know you by) may be shown the same way when you have not set a display name. Standings, including points and totals, are public on the site, and we or others may share screenshots of them on social media. Anyone can see this information, and we cannot control how others use what they see.
DEX: which species you have ticked in your DEX is never shown publicly. Only your DEX total is shown, and only if you turn on "Show my total" on your DEX page. The shop owner can see DEX progress to help source cards; otherwise it stays private.
We do not publicly show your email address, shipping address, or purchase prices. Choose a display name that does not reveal personal details you want to keep private. You may ask us to hide your profile from public leaderboards by emailing us; we will honor that request going forward, but we cannot recall stream recordings or screenshots that were already made.
6. How we share information
We share personal information only as described here:
- Service providers who process information on our behalf and under our instructions, including:
- Supabase (database, authentication, and storage),
- Vercel (website hosting, delivery, and logs),
- Resend (sending sign-in codes and other emails),
- Google (sign-in, if you choose it),
- Advertising and analytics partners, such as Meta, TikTok, and Google, once we add their pixels or similar tools to the Service. These partners may collect information directly from your browser or device (such as cookie IDs, IP address, device information, pages viewed, and actions like signing up), and may combine it with other information they have, to measure our ads, show our ads to you and people like you, and for their own purposes as described in their privacy policies. California law may treat this as "selling" or "sharing" personal information; see section 7.
- The public, for the leaderboard and profile information described in section 5.
- Platforms you use with us, such as Whatnot, TikTok, and Discord, when needed to credit activity, run giveaways or rewards, assign community roles, or communicate with you there.
- Professional advisers, such as lawyers and accountants, under confidentiality duties.
- Legal and safety reasons, when we believe in good faith it is needed to comply with law or legal process, enforce our terms, or protect the rights, property, or safety of us, our users, or others.
- Business transfers, if we are involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction (including during due diligence), or in bankruptcy. Personal information may be transferred as part of that transaction, and the new owner may continue to use it as described in this policy.
- With your consent or at your direction.
7. Selling, sharing, and your opt-out choices
We do not sell your personal information for money. However, we use, or plan to use, advertising and analytics cookies, pixels, and similar tools from partners such as Meta, TikTok, and Google (see section 9). When those tools are active, our partners may receive information such as cookie and device identifiers, IP address, browser and device information, pages you visit, and actions you take on the Service. Under California law and some other state laws, letting partners collect this information for advertising across different businesses' sites and apps ("cross-context behavioral advertising" or "targeted advertising") may count as "selling" or "sharing" personal information, even though no money changes hands.
As of the "Last updated" date above, these advertising pixels have not yet been added to the Service. We will update this policy, including the list of partners, before or when they go live.
The categories of personal information that may be sold or shared in this way are identifiers (such as cookie IDs, device IDs, and IP address), internet or other electronic network activity, commercial information (such as the fact that you signed up or claimed a reward), and inferences. They are disclosed to advertising and analytics partners. We do not sell or share Google user data, and we do not knowingly sell or share personal information of consumers under 16 without the opt-in consent the law requires.
Do Not Sell or Share My Personal Information
You have the right to opt out of the "sale" or "sharing" of your personal information, and of targeted advertising. You can do this in any of these ways:
- Email us at battlepass@elite4jello.com with the subject "Do Not Sell or Share." Include the email on your account if you have one. We do not need to verify your identity for an opt-out, but we may ask for details to apply it to your account. We will act on your request within 15 business days.
- Use Global Privacy Control (GPC). If your browser or extension sends a GPC signal, we will treat it as a valid request to opt out of selling and sharing for that browser and, if you are signed in, for your account.
- Use our cookie or privacy choices settings once advertising pixels go live. We plan to add a "Your Privacy Choices" link on the site that lets you turn off advertising cookies and pixels.
Opting out through cookie settings or GPC works per browser and device, so you may need to repeat it on each browser or device, and again if you clear your cookies. You can also limit ad personalization directly with Meta, TikTok, and Google through their ad settings, and through industry tools such as optout.aboutads.info and optout.networkadvertising.org. Opting out does not stop all ads; you may still see ads that are not based on your activity across sites.
8. Marketing emails and unsubscribing
If you give us your email address, we may send you marketing emails about our shows, drops, rewards, and promotions. Every marketing email will identify us, have an accurate subject line, include our postal address, and include a working unsubscribe link. You can unsubscribe by using that link or by emailing battlepass@elite4jello.com. We will process unsubscribe requests within 10 business days.
Even after you unsubscribe from marketing, we may still send transactional or account messages, such as sign-in codes, reward fulfillment details, security notices, and changes to our terms.
9. Cookies, pixels, and similar technologies
We use cookies, local storage, pixels (small pieces of code or images that report activity), software development kits, and similar technologies. They fall into three groups:
- Necessary: keep you signed in, remember your session and settings, protect against abuse, and make the site work. If you block these, sign-in and other features may not work.
- Analytics: help us understand how people use the Service, such as which pages are visited and which features are used, so we can improve it. These may be provided by our hosting provider or other analytics partners.
- Advertising: tools such as the Meta Pixel, TikTok Pixel, and Google advertising tags, which let us and our partners measure ad results, build audiences, and show our ads to you on other sites and apps. These tools may collect information directly from your browser, as described in section 7. As of the "Last updated" date above, these have not yet been added; we will update this policy when they go live.
You can control cookies through your browser settings, and you can opt out of advertising cookies and pixels as described in "Do Not Sell or Share My Personal Information".
Global Privacy Control and Do Not Track: We honor Global Privacy Control (GPC) signals as a request to opt out of selling and sharing, as described in section 7. Because there is no common standard for browser "Do Not Track" signals, we do not respond to them separately.
10. How long we keep information
We keep personal information for as long as needed for the purposes in this policy, then delete or de-identify it. As a general guide:
| Type of information | How long we generally keep it |
|---|---|
| Account, linked identities, profile, points, purchase and reward history | While your account is active, and up to 3 years after your last activity, unless you ask us to delete it sooner |
| Shipping and fulfillment details | Up to 2 years after the reward ships, or longer if needed for tax or accounting records |
| Marketing preferences and unsubscribe records | As long as needed to honor your choice |
| Device, usage, and security logs | Usually up to 12 months |
| Communications with us | Up to 3 years after the conversation ends |
| Records we must keep by law (for example tax records) | As long as the law requires |
We may keep information longer if needed to resolve disputes, prevent fraud, enforce our terms, or comply with law.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, such as encrypted connections, access controls, and limiting staff access. No system is perfectly secure, so we cannot guarantee security. If we learn of a breach affecting your personal information, we will notify you as required by law.
12. Children and teens
The Service is not directed to children under 13, and you must be at least 13 years old to use it. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it and close the account. If you believe a child under 13 has given us information, please contact us at battlepass@elite4jello.com.
If you are under 18, please review this policy with a parent or guardian. Some platforms we work with, such as Whatnot, may have higher minimum ages; you must meet each platform's own age rules to use it. California users under 18 may ask us to remove content or information they posted on the Service by emailing us. This does not guarantee complete removal (for example, if someone else copied or reposted it).
13. Your choices and rights
Wherever you live, you can:
- Review and update your display name, avatar, and some profile details in your account.
- Ask us for a copy of your information, to correct it, or to delete your account.
- Ask us to hide your profile from public leaderboards.
- Unsubscribe from marketing emails at any time.
- Disconnect Google, or ask us to unlink a Whatnot, TikTok, or Discord identity.
To make a request, email battlepass@elite4jello.com from the email address on your account. We may need to verify your identity before acting, and we may keep some information where the law allows or requires (for example, records of a reward we shipped, or information needed to prevent fraud). Deleting your account ends your points, rewards, and cosmetics; see our Terms of Service.
14. California privacy notice
This section applies to California residents and supplements the rest of this policy. It is provided under the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the "CCPA").
Categories of personal information we collect and disclose
In the past 12 months we have collected the following categories. For each, the sources are those in section 2, the purposes are those in section 3, and we disclose it for business purposes to the recipients listed. In the past 12 months we have not sold personal information for money. The last column shows which categories may be sold or shared once advertising pixels go live (see section 7).
| Category (CCPA) | Examples | Disclosed for a business purpose to | May be sold or shared (via ad pixels) with |
|---|---|---|---|
| Identifiers | Name, display name, email, account IDs, platform usernames, IP address | Service providers; platforms you use with us; advisers; legal and business-transfer recipients | Advertising and analytics partners (cookie/device IDs, IP address) |
| Customer records (Cal. Civ. Code § 1798.80(e)) | Name, shipping address, email | Service providers (such as shipping); advisers | Not sold or shared |
| Commercial information | Purchases and wins at our shows, points, rewards, cosmetics | Service providers; advisers | Advertising and analytics partners (events such as sign-ups or reward claims) |
| Internet or other electronic network activity | Pages viewed, actions, logs, email engagement | Service providers | Advertising and analytics partners |
| Audio, electronic, visual, or similar information | Profile picture, avatar, messages you send us | Service providers; the public (avatar only) | Not sold or shared |
| Inferences | Interests, engagement level, customer group | Service providers | Advertising and analytics partners |
Display name, avatar, points, and rank are also made public as described in section 5. We do not collect sensitive personal information for the purpose of inferring characteristics about you, and we use any sensitive personal information we do process (such as account login credentials) only for purposes allowed by the CCPA, so we do not offer a "limit the use of my sensitive personal information" option. Retention periods are in section 10.
Your California rights
- Right to know what personal information we collected, its sources, our purposes, and who we disclosed it to, and to get a copy of specific pieces of it.
- Right to delete personal information we collected from you, subject to legal exceptions.
- Right to correct inaccurate personal information.
- Right to opt out of the sale or sharing of personal information. See "Do Not Sell or Share My Personal Information".
- Right to limit the use of sensitive personal information, where it applies (see above).
- Right to non-discrimination for exercising these rights. We will not deny you the Service, charge a different price, or provide a different quality because you exercised a right, except as allowed by law (for example, deleting your account necessarily ends your points; see section 15).
How to make a request: email battlepass@elite4jello.com with the subject "California privacy request." We will confirm receipt within 10 business days and respond within 45 days (we may extend by another 45 days with notice). We will verify your request by matching information you give us to information we hold, usually by confirming control of your account email. You may use an authorized agent; we may ask for signed permission from you and ask you to verify your identity directly.
Shine the Light: California Civil Code § 1798.83 lets California residents ask about disclosures of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
15. Notice of financial incentive
The Battle Pass is a loyalty program. Points, tiers, chases, rewards, and cosmetics are benefits linked to the personal information you give us (such as your email, linked platform usernames, and purchase and activity history), so under California law the program may be considered a "financial incentive."
- What you get: the chance to earn points and the program benefits described on the Service and in our Terms of Service, which can change.
- What information is involved: the categories in section 14, especially identifiers, linked usernames, and commercial information.
- How to join: by creating an account and linking your platform identity. Joining means you agree to this incentive.
- How to withdraw: at any time by asking us to delete your account at battlepass@elite4jello.com. You will lose unredeemed points and benefits, because we cannot run the program for you without the information.
- Value of your data: we do not assign a dollar value to an individual's personal information. We estimate its value to us as roughly equal to our reasonable costs of running the program for you (the rewards, cosmetics, and fulfillment we provide), which we consider a good-faith estimate that is reasonably related to the benefits offered.
16. Other US states
Residents of some other US states (for example Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and others) may have similar rights under their state laws, such as the rights to access, correct, delete, and get a copy of personal information, and to opt out of targeted advertising, sale, or certain profiling. We may use personal information for targeted advertising as described in section 7, and you can opt out of it (and of any "sale") in the ways described there, including with Global Privacy Control. We do not use personal information for profiling that produces legal or similarly significant effects. To make other requests, email us as described in section 13. If we decline your request, you may appeal by replying to our decision with the subject "Privacy appeal"; we will respond within the time your state's law requires. If your appeal is denied, you may contact your state attorney general.
17. Third-party platforms and links
Whatnot, TikTok, Discord, Google, and other services we link to have their own privacy policies, and their handling of your information is governed by those policies, not this one. For example, your purchases on Whatnot or TikTok, and payments for them, are processed by those platforms. We are not responsible for third-party practices.
18. Where data is stored
We are located in the United States, and our service providers may store and process information in the United States and other countries. If you use the Service from outside the US, you understand your information will be transferred to and processed in the US, where privacy laws may differ from those where you live.
19. Changes to this policy
We may update this policy from time to time. We will post the new version here and change the "Last updated" date. If we make material changes, we will give you notice in a reasonable way, such as on the site or by email. If a change would let us use personal information in a materially different way from what we said when we collected it, we will get your consent where the law requires.
